No other serious crime requires that the victim prove lack of consent. People aren’t asked if they wanted their house broken into or if they enticed someone to beat them up and steal their wallet. Yet if women cannot prove that they resisted or cannot find someone to corroborate their story, consent (or even latent desire) may be presumed. (Siegel, 2004).

While in a hospital waiting room after being brutally raped, a Madison, Wisconsin, woman was required to submit a “statement of nonconsent” in which she swore she hadn’t given her knife-wielding assailant permission to rape, cut, and rob her (Lueders, 2006).
